Courts across the United States have sanctioned lawyers for filings containing citations to cases that do not exist. In July 2024 the American Bar Association issued Formal Opinion 512, its first ethics guidance on generative AI, confirming that the duties of competence, confidentiality, communication, supervision, and reasonable fees all apply to a lawyer’s use of these tools. A growing number of courts require disclosure of AI use in filings, and the requirements vary by court.

Most practitioners using AI have no training, no documented standard, and no record of how they verified what the tool produced. “I used ChatGPT” is not a defense before a disciplinary authority.

The Responsible AI Certified Professional™ (RAICP), Legal Edition, is independent third-party verification that you understand the risks, follow a documented standard, and apply AI responsibly in client work. It is issued by the National Institute for Responsible AI Practice (NIRAP), a standards body.

What the curriculum covers:

  • AI literacy: hallucination, sycophancy, bias, confidence versus accuracy
  • Risk identification and triage at the level of the task rather than the tool
  • Competence, confidentiality, candor to the tribunal, and supervision of AI-assisted work
  • Verification against primary sources, and what a defensible record looks like
  • Fee and billing questions raised by AI-assisted work
  • Court standing orders and disclosure obligations, and how they vary by court
